Terms of Service of IOT

Sinoboom after sales system (hereinafter referred to as the "IOT") refers to the platform service provided by Sinoboom to you. This agreement is a valid contract entered into by and between you and Sinoboom on the use of the Service and other related issues. Once you log into IOT, it will be deemed that you are aware of, understand and agree to accept all contents of this agreement and all legal consequences arising therefrom will be borne by you.

Before accepting this agreement, please read carefully and fully understand all contents of this agreement. Please pay special attention to the clauses on the exemption or limitation of liabilities, and separate agreements on the activation or use of specific services, in which case you should decide to accept or reject such agreements (if any). Please do not proceed if you disagree with any content herein or cannot accurately understand the meanings of relevant clauses.

Eligibility and Account of the User

1. The user shall be a natural person with full capacity of conduct, or other legal entities with the ability to independently assume legal responsibilities. Users who are persons without the capacity of civil conduct, persons with limited capacity for civil conduct, or other entities without the ability to independently assume legal responsibilities shall carry out transactions under the guardianship of their guardians or obtain the authorization of the competent party.

2. Before using IOT, users shall check their hardware and software equipment to ensure that they are safe to use.

Use

1. You voluntarily use IOT, and must comply with the regulations, agreements and transaction rules related to the service that you will receive through IOT.

2. You understand that the IOT Service is provided by Sinoboom through the Internet. A login failure, slow web velocity, information delay and error, temporary unavailability of service, cancellation, suspension or termination of service may occur during your use of IOT Service due to failures of network or communication lines, power outage and other factors that are unpredictable and uncontrollable for Sinoboom. In case of the occurrence of any of aforesaid issues, you may re-use relevant services on IOT after such unexpected factors are eliminated. Sinoboom will not be responsible for any losses suffered by you due to the aforementioned unpredictable and uncontrollable factors and other reasons that are not attributable to Sinoboom.

3. You understand and agree that: in order to provide you with effective services, IOT will use resources such as the CPU and bandwidth of your terminal device. Data traffic costs may arise from the use of IOT. You need to acquire relevant price information from the operator and bear the costs independently.

4. You guarantee that the information provided by you to Sinoboom is authentic, legal, valid and complete. The consequences arising from the unavailability or any error of the Service due to your failure to provide authentic, legal, valid and complete information or your failure to timely notify Sinoboom of any changes of such information shall be independently borne by you. If it is reasonably believed by Sinoboom that you are suspected of providing unauthentic, illegal, invalid or incomplete information, Sinoboom has the right to reject, suspend or terminate the provision of the Service without bearing any responsibilities, and all responsibilities and losses arising therefrom shall be borne by you.

5. You are responsible for properly keeping your account, password and other information related to the Service. The transactions performed by using aforesaid information shall be deemed to be performed by you in person. You shall bear the consequences and responsibilities arising from any risks or loss of funds due to the loss of control of such information. Your transaction information shall be subject to Sinoboom's system records, of which the authenticity, accuracy and legality are acknowledged by you, except to the extent that there is conclusive evidence that Sinoboom's system record is wrong.

6. You shall not use IOT Service for illegal acts, including but not limited to fraud. If it is reasonably believed by Sinoboom that you are suspected of carrying out illegal acts, Sinoboom has the right to suspend and cease the provision of services or take other reasonable risk control measures.

Representations and Undertakings

1. You understand and agree that: in order to improve the service content and service experience, Sinoboom has the right to upgrade and transform the platform system and adjust the functions, contents and methods of platform service as required by business development.

2. Sinoboom has the right to modify this agreement as required by laws, regulations, policies, as well as system upgrading, business development and other reasonable causes, and you may view the clauses of the updated agreement on the login page of IOT. If you continue the use of IOT after the clauses of this agreement are changed, it is deemed that you have fully read, understood, agreed upon and accepted the revised agreement. You shall stop using IOT if you do not accept the revised agreement.

3. In the process of getting registered or using the Service, you need to provide necessary information to IOT, including but not limited to your email for the purpose of user identification or account registration.

4. Sinoboom will use professional technical means to encrypt the storage and transmission of relevant information to ensure the safety of your personal information. Unless otherwise stipulated by the laws and regulations or agreed in this agreement, Sinoboom guarantees that your personal information will not be disclosed or revealed to third party without your consent.

Limitation of liabilities

1. Sinoboom shall in no case be responsible for nonperformance or delayed performance due to normal network equipment maintenance, network connection failure, failure of computer, communication system or other systems, malfunctions inside the outlet, strike, rebellion, riot, catastrophic weather events (e.g. fire, flood and hurricane, etc.), explosion, war, government act, order of judicial administrative organs, and omission of third party.

2. Sinoboom is not responsible for the loss of relevant information or records because the system of IOT crashes or cannot be used normally due to the above force majeure or other reasons beyond the control of Sinoboom, provided that Sinoboom will assist in making remedies as reasonably as possible and try every effort to protect customers from economic losses.

3. You are aware of and understand that there may be lags or errors of the information displayed on IOT due to special nature of internet. You must independently discern the false from the genuine and prevent risks carefully.

Miscellaneous Provisions

1. The dispute (if any) between you and Sinoboom shall be resolved through negotiation. If no consensus is reached through negotiation, legal proceedings shall be initiated before the court of the place where the head office of Sinoboom is located.

2. The execution, effectiveness, performance, interpretation and dispute settlement of this agreement shall be governed by the laws of the mainland of the People's Republic of China (or the prevailing domestic common practices in case of the unavailability of explicitly provided provisions of the law).

3. The invalidity or unenforceability of any clauses herein for any reason shall not affect the validity of other clauses.

4. Matters uncovered herein shall be handled in accordance with the laws, regulations, relevant business rules of Sinoboom, and prevailing domestic common practices.
